Sports Law

Sports betting and gambling

Following the judgment of the European Court of Justice of 8 September 2010 on the German gambling monopoly (C-409/06, C-316/07, C-46/08) and the subsequent complications upon adopting a uniform State Treaty on Games of Chance, the importance of sports betting in Germany has grown considerably. The single-handed approach followed by Schleswig-Holstein up until February 2013 in relation to issuing temporary licences for entities offering online gambling has created additional confusion. A new vote by the CJEU on the current legal position in Germany is expected in 2015.
We advise sports bodies on the legal implications of sports betting in Germany and beyond.
