Following the judgment of the European Court of Justice of 8 September 2010 on the German gambling monopoly (C-409/06, C-316/07, C-46/08) and the subsequent complications upon adopting a uniform State Treaty on Games of Chance, the importance of sports betting in Germany has grown considerably. The single-handed approach followed by Schleswig-Holstein up until February 2013 in relation to issuing temporary licences for entities offering online gambling has created additional confusion. A new vote by the CJEU on the current legal position in Germany is expected in 2015.We advise sports bodies on the legal implications of sports betting in Germany and beyond.
